A question that we often get asked is what can be done where superannuation assets are unable to be held in the fund's name, most often as a result of State legislation not recognising a trust arrangement for registration purposes, for example registration on a State's land titles register or on a company shareholders register. How does the fund prove that it is the owner of the registered asset even though the register does not mention the fund?SMSFs as 'wholesale clients' or 'sophisticated investors'

It can be beneficial sometimes for an SMSF to be considered a 'wholesale client' or a 'sophisticated investor' in order to get access to investments that might not be open to 'retail clients' because the promoter doesn't want to go to all the expense and trouble of fully complying with the securities law requirements for 'retail clients'.
