A number of our SMSF clients have told us recently that when arranging a loan from their bank the Bank advised them that it would be cheaper to have the holding trust deed and associated documents prepared by the Bank's lawyers. Regular readers of BLB will be well aware that the new Personal Property Securities Act 2009 (PPSA) is now in force throughout the entire Commonwealth of Australia and is certainly stirring up the grey matter in legal and accounting offices throughout this fair land. As we said in our last issue, businesses need to tread warily to ensure that they comply with the PPSA so they can maximise any priority they may have in securities they take over personal (including corporate) property.
